Government through the Director of Business Environmental Impact Prevention and Activities of the Directorate General of Forestry Planning and Environmental Management, Ministry of Environment and Forestry, Ir Ary Sudijanto M SE, discloses the environmental impact control strategy regulated in Law No.11 2020 concerning Job Creation. In the forum it was also stated that environmental control was getting stronger because it was supported by high technology in its supervision and implementation.
In a National Webinar organized by the Diponegoro University (UNDIP) Environmental Science Doctoral Program, Wednesday (11/25/2020), Ary Sudijanto said that environmental control, which was originally based on licensing, in the Ciptaker Law was changed to be risk-based. The change does provide convenience but does not change the commitment to protecting the environment.
According to Ary, for businesses that have a big risk, there is still a need to attach an environmental impact analysis (Amdal), while for those with a small risk, environmental supervision is included in the Business Identification Number (NIB). In making Amdal, the government involves the community in a broader sense in public consultations and announcements.
In essence, the Ciptaker Law covers all environmental aspects, be it environmental permits, Amdal for industry, management permits and others. In the Ciptaker Law there is also a division of types of businesses and / or activities based on the Law documents. The government is currently deploying an aspiration team to seek improvements in its implementation.
With regard to criminal sanctions in their application, it is confirmed that they still exist, especially as sanctions for defamation. Meanwhile, administrative fine provisions are also made with separate calculations that make more sense. For example, for wastewater quality standards related to administrative sanctions, it will be calculated based on errors. Even with regard to health, safety and the environment, there are administrative sanctions for repair and fines for companies. "So the Law does not weaken the environment but wants to strengthen the environment," he explained.
As is well known, environmental problems are one of the sectors affected by the implementation of the Job Creation Law. There are many elements that were originally regulated in the Environmental Law undergoing changes. Responding to this condition, the UNDIP Environmental Science Doctoral Program held a National Webinar to find solutions to problems that could potentially occur due to these changes.
Dean of the UNDIP Postgraduate School, Dr. RB Sularto SH MHum, when opening the webinar said, Law Number 11 of 2020 concerning Job Creation is like a newborn and is treated in various ways. Considering that the law has not been implemented, the impact cannot be seen.
This webinar is expected to provide academic input regarding the birth of the Job Creation Law, so that it can predict potential environmental impacts. "I hope that the participation of participants and resource persons will provide input, and become materials that can produce studies in the future," hoped Sularto.
